That is true but it makes it very hard to vote them out when they have so much money as to control the media and insure the only competition around thinks the same way they do. Then you are voting for either Satan or Lucifer.

Federal law strictly defines what is a firearm. Airguns are exempt, as are pre-1898 guns, muzzleloaders, etc. A silencer is treated the same as a machine gun or grenade launcher or bazooka(all of which are technically legal).
The ATF is notoriously indecisive when enforcing "laws." I don't know what crazy country you're from, but don't send even an airgun silencer to America. You just might have an extradition treaty to deal with. If you're already here, feel free to silence whatever you want. It's pretty hard to convince a jury that you should go to jail for 10 years/pay $10,000 for silencing a mere BB gun.

Hi Joe,and welcome to AGH!True airguns are exempt,but as stated in my above post a silencer is legally defined in the U.S. as a firearm "just by itself" according to Federal law,and the BATF,so if the silencer goes on the air gun,you have just turned said air gun into a firearm,so it legally falls right back into the jurisdiction of the BATF.If they decide to prosecute your pretty much up sh!t creek.Hey I think it's absolutely absurd,but it doesn't change the law.

The penalty isn't dictated by a jury,that is the magistrate's duty,based on sentencing guidelines once a guilty verdict is reached,and it would be fairly easy case to prove,if they were going after a conviction.From what I gather there is mandatory sentencing for silencer cases,so the magistrate has no say...if your found guilty you go away.Here is a great article "though rather long" on the subject.Sure BATF can be somewhat indecisive on what they enforce,but if focus were to shift,and they were to really start going after people for the silencer thing,a person could get 10 years easy,and that's if they have mitigating circumstances.. Wink
The gentleman in the article was sent away for 15 years,and last I heard they were trying to stretch it to 22 years.Not really worth the risk if you ask me....

Sorry Joe but that is a risky statement to make especially on an open forum and I am sure it is not the opinion of the forum. Further what makes you feel it is hard to convince a jury of anything? People are quite easy to convince of anything if it is put in a convincing light which is what lawyers and advertisers do.

If you are in the USA and you put a silencer on your air gun you are breaking the law. So don't do it.

After reading Beeman's article,it sure seems like it could be a potential gray area there,and open to Interpretation.

So far they seem to be okay to have,because it seems that there must be a loophole,which I don't fully comprehend,but wouldn't want to be around if the loophole gets pulled tight.That being said,I don't think I'll be owning one just to play it safe.Time to put aside some coin for a .25 M-Rod.With the way things seem to be headed,it wouldn't surprise me one bit,if our Government started making ridiculous,and unfounded decisions concerning the shrouded AG's as well.... Rolling Eyes

Yeah,I'm sure they must be okay to have,or people wouldn't be selling them.I'm just wondering what the difference is as defined by the law.Perhaps they are designed to destruct during that one shot test the BATF does to determine the 1db sound decrease when the device is attached to a firearm???I don't know.I just find the issue a-little sketchy.I have a tendency to over analyze at times.It's just that when you see some poor bastard going away for 20 years,for something as ridiculous as an AG silencer,it just doesn't sit right with me is all I'm saying.Perhaps you could ask Tim at Mac1 when you pop in next?He knows a-lot more than me on this I'm sure....

Oddly enough I recently had reason to ask the Ohio main BATF a question so I called them by phone.
I've done this before and they have always been willing to answer your questions even if they have to call the A.G. office for an opinion.
I wanted to know if muzzle loaders were considered "firearms".
The answer was NO, but if it is a moder muzzle laoder or what we commonly refer to as an inline fireing mechanisim it is considered by the BATF to be a firearm though you do not need to fill out the yellow form 4473 when you buy one.
A cap lock, or flintlock is NOT a firearm, weather an original antique or replica of an antique, it's still NOT considered a fireamr.
However, in Ohio, ANY muzzle laoder is considered a fiream. Don't matter what the Feds say, your great grandfathers flintlock squirrel gun is a "firearm" in Ohio. So is a replica of a flintlock or cap lock.
Though anyone over 18 (or 21?) can buy a replica cap or flintlock with no paper work, no background check, no nothing, it's still a firearms in Ohio, but and this is strange too, the antique or replica of an antique muzzle loader is NOT defined a destructive device in Ohio.
Go figure.
In South Africa ( I have a pen pal there) ALL air guns are fireams, must be regsistered and licensed PRIOR to buying the thing.
So you can go pay for a break barrel Gamo .22, then and only then, apply for the license to own it which takes months.
There they can and do ask your nieghbors if they feel you should or should not have said airgun.
If only one nieghbor says no, a reason does not have to be given, then you're out your money for the airgun, and the license fees.
Though most shops will return your money they are not obligated to do so.
If you own a firearm (airguns too) you MUST have an approved security system added to your home as well as an approved safe.

Needless to say but over there black powder guns fall under the same draconian laws. In fact you can only own ONE pound of powder at a time, never more than one.
To go to a range and shoot a muzzle loader you CAN NOT take the can of powder with you. You MUST, by law, take pre-weighed charges for the number of rounds you want to shoot.
Thank God and I MEAN THANK GOD, we have the 2nd amendment and never forget we must fight hard to keep it.

It was asked early on in this thread when the ATF will go after ag's like the whisper or M-rod. Concidering what we've seen written here occationally by those that admittedly do irresponcible things with thier ag's, and knowing there's probably 10x or more irresponcible ag owners out there in the world this is what I'm thinking will ruin it all for the rest of us....

We've all read threads were someone bragged about taking birds off power lines, or others shooting at squirrels in a nieghbor's tree, or simlar stupid acts.

It'll be one of those idiots shootting at who knows what with no thoughts of what's down range, and somebody get's injured. As a parent of a small child, I can only think the worst situation would be a young child innocently playing in a sand box or toddler pool when they get hit in the side of the head by a pellet from some sob that didn't think about where he was aiming.

Hopefully he will be caught. But the damnage will be done. Our wonder left wing controlled press will make more of an issue about the "silenced" "HIGH POWER" rifle the sob used, then the fact he was just being stupid where he was using it.

Next thing to happen is the lefties will need to write yet another law to protect us from ourselves. Again they will blame the tool and not the opperator. And from then on we will only talk about when we once were able to buy such ag's.
