I just had an e-mail asking if I would make and supply a silencer to a guy in Hawaii, am I right in thinking that it's part of the USA and comes under their gun laws?

It is a federal law- so it applies to Hawaii. If the guy has the proper permit, OK, otherwise he's asking you for something he shouldn't.

If you want to check or refer the person to the appropriate governing legislation/body, it's the Bureau of Alcohol, Tobacco and Firearms (ATF): http://www.atf.gov/

It has been a state (equal to the the 49 others) since 1959. Maybe the guy hasn't read a newspaper in a while.

I don't want to get him into trouble so I'll just e-mail him back pointing out the error of his ways.

Just out of interest, are silencers for airguns covered by the same laws for firearms?

Any kind of silencer that can be removed and put on a firearm, (note I said removed. This means any kind of removal, such as sawing it off and putting on on a firearm which includes welding and any other way) is illegal. Period. End of sentence. Go to jail like forever kind of illegal. THat's why I don't have a gamo whisper. Knowing my luck I would be the poor barsturd who got prosecuted.

It seems like all the airgun manufacturers are playing some sort of "nudge nudge wink wink" game with the BATF- but someday someone's gonna get f#&ked- wonder who it will be. Probably whichever company pisses off a BATF inspector the most...

i couldn't agree more. it makes me wonder about guns
like the mrod, i mean it's truly a "silenced" gun.
there's baffles in there. it makes NO noise.
there is no negotiating around the fact... it's silenced.

it's only a matter of time before airguns hit the gun control table.
i just wonder where it leaves people like us mrod owners since-by definition-it is a silenced gun. Question

i had to become a registered "assult gun" owner with the U.S.
DOJ 10 years ago because of a stupid friggen law. Rolling Eyes

I think the way around this, is the use on a firearm. I know that firearms are much more powerful than airguns, and I think that my LDC would probably take out an eye, or a 10 yard target if I tried to stick it on a firearm.

Here in Pflugerville Texas they have changed the wording in the definition of the law on airguns so that now airguns are considered firearms. When you call the police and ask about the legality of firing a pellet gun in Pflugerville the officer will apologize but say it is illegal. So it doesn't matter whether it is on an airgun or a burner a silencer is illegal.

But the ATF is a federal bereau. And federal law doesn't say that airguns are firearms. All of Michigan is the same as P-ville.

It would seem to be the case, however if you look at the Federal definition of a firearm,a silencer "just by itself" without being attached to anything, is considered a firearm. That is where they have you.So if you attach a silencer to "anything" or "nothing" it is a firearm..."Scary".Also the test is that if said device is capable of being used to quiet the report of a gun for only one shot, and decreases the report by only 1 decibel, they have you. That is scary, because of course an air gun suppressor will only last one shot on a powder burner....but if you get that 1 decibel decrease your done, and could wind up hanging out with "Bubba"in a Federal prison for a decade or so.I also wouldn't be suprised if they use .22 subsonic rounds during their testing to help clinch a conviction..... well, a silencer is almost useless on any gun with supersonic rounds. With smallbore weapons with relatively small powder charges, the sonic boom of the bullet breaking the sound barrier can be louder than the actual muzzle report.

In fact, when I first got my Storm XT home, the first few shots dieseled thanks to too much factory lube and sent the pellet past the sound barrier. Those first two shots were as noisy, if not slightly noisier than my Remington 597.

Exactly....hence my comment on subsonic ammo. That's why if the Feds tested a silencer with subsonic rounds, the effect would be far more noticeable, thus incriminating....but I'm sure they know that already, and wouldn't hesitate to go that route,if they wanted to take someone down.

most of, if not all, the paranoid legislation pertaining to firearms, use, ownership and possession is there because WE have allowed legislators to get away with passing them...it's that simple folks...

today may be another landmark in gun ownership/possession, too...the supreme court will decide on the ban of handguns in Chicago being 'legal' or not.

you may rest assured that if the ruling goes in favor of the gun owners, the city will probably draw up some very draconian other ordinances to replace the ban. (they probably have some in waiting, just in case)

governmental entities do NOT like being told they're wrong! especially by the courts as they feel as though, for some reason, they believe they cannot be wrong.

the ONLY answer is to remove those who enact such laws from office...vote them OUT or don't vote for them until you know their stand on gun rights and the 2nd amendment...it's that simple.
